The deal, in plain language
Clawback is operated by Tarkin Professional Services Limited, a British Columbia, Canada company ("we", "us").
The free scanner
The scan is free and provided as-is. Its results are estimates based on the files you provide and published carrier policies. Carriers decide every refund, guarantee terms change by service level and over time, and we do not warrant that any specific amount will be recovered. The scanner is not financial, legal, or accounting advice.
The recovery service
Filing claims on your behalf is a separate engagement that begins only when you explicitly agree to it in writing (email is fine). The short version of that agreement: you authorize us to prepare and submit refund disputes on your carrier account; refunds credit directly to your carrier account, never to us; our fee is 25% of refunds actually credited, invoiced after the fact with 7-day terms; no refunds recovered means no fee, ever; and either of us can end the engagement at any time with notice, with fees owed only on refunds already credited.
Liability
To the maximum extent permitted by law, our total liability for anything arising from the scanner or the service is limited to the fees you paid us in the three months before the claim arose. We are not liable for carrier decisions, indirect damages, or lost profits.
Governing law
These terms are governed by the laws of British Columbia, Canada.
